Legal Writing: Striving for Clarity

A 2-Part CLE Series on Legal Writing Airing

Presented by The Florida Bar’s Appellate Practice Section and Business Law Section

The Honorable Robert E. Bacharach, a Judge with the Tenth Circuit Court of Appeals, will discuss some of the key concepts addressed in his recent book, Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word, published by the ABA Press. In the programs, Judge Bacharach will discuss ways to enhance the clarity of our legal writing, focusing on four techniques: (1) creating context before detail; (2) relaxing diction; (3) linking information by putting old information before new information; and (4) conveying information in manageable chunks. Judge Bacharach will draw lessons from studies in linguistics, psycholinguistics, and oratory, and illustrate these techniques with powerful examples of legal writing. The first two techniques are discussed in part I of the series while techniques 3 and 4 are covered in part II.
